Using the Site

You must be at least 18 years old, or have a parent or legal guardian involved, to request an appointment, send us information or agree to receive text messages. Please use the Site lawfully and in a way that does not interfere with its operation, security or accessibility for anyone else.

Information, not medical advice

The Site describes our practice, our surgical, skin and non-surgical treatments, and general patient education. It is for information only. It is not medical advice and does not replace an in-person examination, diagnosis or treatment plan.

Using the Site does not create a doctor-patient relationship. That relationship begins only when our office accepts you as a patient. Whether a treatment suits you can only be decided at a consultation.

If you think you have a medical emergency, including a complication after a procedure, call 911 or go to the nearest emergency room. Do not rely on the website form, text messages or email for anything urgent.

Appointment requests

Sending a request through the Site does not guarantee an appointment. An appointment is confirmed only when our office contacts you to confirm it. Please give accurate and complete information. We may reschedule or decline a request because of availability, surgical commitments, missing information, clinical suitability or other reasonable grounds.

Consultation fees and deposits are explained on our booking page and confirmed when you book.

Phone and email

By giving us your contact details, you agree that we may contact you about your request, appointment or treatment by phone, voicemail, email and, where you have agreed, text message. These messages may include confirmations, reminders, pre-operative and post-operative instructions, follow-ups and replies to your questions.

The phone number shown on the Site may be a tracking number that forwards to our office, so that we can see which pages lead to calls. Our Privacy Policy explains what that records.

Website forms, text messages and ordinary email are meant for routine questions and scheduling. Please do not send detailed medical, insurance or financial information through them; call our office instead. Information you give us as a patient is also governed by our Notice of Privacy Practices under HIPAA, available at our office and on request.

SMS terms

Stone Surgical Arts PLLC, 72 Andorra Dr #110, Westlake, TX 76262, sends text messages to patients and prospective patients through a third-party messaging platform.

How you opt in

You opt in by giving us your mobile number and agreeing to be contacted by text, on a form on the Site or in writing. Consent is not a condition of any purchase or of receiving care. By opting in, you agree to receive recurring automated and conversational text messages at that number, and you confirm that the number is yours or that you are authorized to enroll it.

What we send

• Appointment messages: confirmations, reminders, rescheduling notices, and pre-operative and post-operative instructions.
• Conversational messages: replies from our team to your questions, or to arrange your consultation or procedure.
• Promotional messages: treatment news, membership information and offers, only if you have separately agreed to receive them.

Program details

• Message frequency varies with your appointments and your conversations with us.
• Message and data rates may apply. We do not charge for our messages.
• Reply STOP to any message to cancel. We will send one final message confirming it, and then no more. To rejoin, opt in again or call us.
• Reply HELP for help, call (817) 631-4619 or email [email protected].
• Supported on major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. It is shared only with the messaging platform and carriers that deliver our messages. Text messages are not fully secure and can be intercepted, so please keep sensitive information out of them. Our Privacy Policy explains how we handle text-message data.

Photographs and virtual consultations

If you send us photographs, you confirm that you have the right to share them. Photographs and information sent for a virtual consultation allow a preliminary, non-diagnostic opinion only. A treatment recommendation needs an in-person examination, and any early opinion may change once you have been examined.

Fees, memberships and financing

Fees shown on the Site are a general guide, not a quote. Your fee depends on your anatomy, the treatment plan and what is included, and is set out in writing after your consultation. The written quote is the figure that applies. Fees may change without notice.

Memberships are governed by the membership agreement you sign with us, which prevails over anything on the Site.

Financing through Sunbit, CareCredit or any other lender is offered by that lender, not by us. We do not control approvals, credit requirements, rates or repayment terms. Please take questions about a financing decision or account to the lender.

Third-party services and links

Some features are provided by other companies, including LeadConnector (Go High Level) for the consultation request form, call tracking and messaging, Termly for cookie consent, Modento for online booking, Sunbit and CareCredit for financing, and Google Maps for directions. The Site also links to our social media profiles and other websites. Those services have their own terms and privacy policies. We are not responsible for their availability, content, security or practices, and a link is not an endorsement.

Your responsibilities

When you use the Site or our messages, you agree to:

• Give truthful, accurate and complete information, including a mobile number you own or are authorized to use
• Use the Site and our messages only for genuine personal or patient purposes
• Not send false or unauthorized requests, or enroll a phone number that is not yours
• Not try to disrupt, damage, reverse engineer or gain unauthorized access to the Site, our messaging platform or any connected service
• Tell us if your contact details change and you still want to hear from us

Our content

Everything on the Site, including text, photographs, before-and-after images, videos, graphics, logos and design, is owned by or licensed to Stone Surgical Arts PLLC and protected by intellectual property law. You may not copy, republish, distribute or modify it without our written permission, except to view it or print a page for your own personal, non-commercial use.

Third-party trademarks named on the Site, including MyEllevate®, belong to their owners and are used only to describe the treatments we offer.

Results and reviews

Individual results vary. Before-and-after photographs and patient reviews show the experience of particular patients and are not a promise or guarantee of your result. Every surgical and non-surgical treatment carries risks, which are discussed with you before you decide.

Disclaimers and liability

No warranties

The Site, our text messages and their content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Site or our messages will always be available, current, complete, error-free or delivered without interruption. You use them at your own risk.

Limitation of liability

To the fullest extent the law allows, Stone Surgical Arts PLLC and its owners, staff and affiliates are not liable for any direct, indirect, incidental, consequential, special or punitive damages arising from your use of, or inability to use, the Site or our messages; errors or omissions in content; delayed or failed communications, including text messages; technical problems; unauthorized access to information you send; or your use of third-party services.

This does not limit any liability that cannot be limited by law, and nothing in these Terms limits liability arising from the clinical care we provide.

Indemnity

You agree to defend, indemnify and hold harmless Stone Surgical Arts PLLC and its owners, staff and affiliates against any claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of the Site or our messages (including enrolling a phone number that is not yours), or your breach of any law or anyone else’s rights.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute about these Terms or the Site must be brought only in the state or federal courts in Tarrant County, Texas, and you consent to their jurisdiction.

General terms

If any part of these Terms is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and Stone Surgical Arts PLLC about your use of the Site and our text messages, and replace any earlier agreement on that subject. They do not replace the consent forms, financial policies or membership agreements you sign as a patient.
